1. Agreement to Terms

By accessing or using Temporal.ist ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using Temporal.ist, you represent that you are at least 18 years of age or have the consent of a parent or guardian.

2. Description of Service

Temporal.ist is an automatic time tracking application that monitors file save events in user-specified folders to record work sessions. The Service includes:

• Automatic detection and logging of file save timestamps
• Dashboard and calendar visualizations of tracked time
• Project and client organization features
• Invoice generation and export capabilities
• Team collaboration tools (where applicable)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Privacy and Data Collection

Your privacy is important to us. Our data collection practices are designed to be minimal and privacy-respecting:

• What we collect: We only collect file save timestamps, folder paths, and file names from folders you explicitly designate for tracking.
• What we do NOT collect: We never read, access, upload, or store the contents of your files. Your actual work remains entirely private on your device.
• Data storage: Timestamp data is stored securely and encrypted. You may delete your data at any time.

5. Subscription and Payments

5.1 Free Tier

Temporal.ist offers a free tier with limited features. Free accounts may track up to 3 folders with 30 days of history retention.

5.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method automatically at the start of each billing period.

5.3 Refunds

We offer a 30-day money-back guarantee on all new paid subscriptions. After 30 days, payments are non-refundable. To request a refund, contact our support team.

5.4 Price Changes

We reserve the right to modify pricing at any time. Price changes will be communicated at least 30 days in advance and will apply at the start of your next billing cycle.

5.5 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that, your account will revert to the free tier.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other malicious code
• Use the Service for any fraudulent or deceptive purposes
• Resell, sublicense, or redistribute the Service without authorization
• Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Temporal.ist and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain full ownership of all files, projects, and content you track using the Service. We claim no intellectual property rights over your work.

8. Third-Party Services

The Service may integrate with or contain links to third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Time tracking data is provided for informational purposes and should be verified before use in billing or invoicing.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TIMEFLOW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Inaccuracies in time tracking or data loss

Our total liability shall not exceed the amount you paid us, if any, in the 12 months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Temporal.ist and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

For significant changes, we will provide at least 30 days' notice via email or in-app notification before the changes take effect.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. You may export your data before termination. After account deletion, we will remove your data in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Temporal.ist operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits against Temporal.ist.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Temporal.ist regarding the Service and supersede all prior agreements, understandings, and communications.
